1. About These Terms

These Terms of Service ("Terms") govern access to and use of the websites, digital guides, courses, downloadable materials, educational tools, communities, and services offered by The Market Hustle LLC ("The Market Hustle," "we," "us," or "our"). These are collectively referred to as our "Services."

When you affirmatively accept these Terms, including through a clearly identified checkout agreement, you enter into an agreement with The Market Hustle. If you do not agree, do not purchase or use Services that require acceptance.

You must have legal capacity to enter into this agreement. If you act for an organization, you represent that you have authority to bind it.

2. Product-Specific Purchase Terms

Each product or service may have separate purchase terms presented before payment, including its price, included materials, access period, delivery details, promotional benefits, payment schedule, and any applicable cancellation, return, or money-back terms.

Those product-specific terms form part of your purchase agreement. If they conflict with these general Terms, the product-specific terms control for that purchase, subject to applicable law. These Terms do not establish a universal money-back policy or replace a product-specific promise made at purchase.

Changes to these Terms do not retroactively reduce benefits or rights associated with an earlier purchase.

3. Educational Purpose and Financial Risk

Our Services provide general financial education. They are not a substitute for personalized advice from an appropriately qualified investment, tax, legal, or accounting professional.

Purchasing an educational product does not, by itself, create an investment-advisory, fiduciary, attorney-client, or other licensed professional relationship. Descriptions in these Terms do not override responsibilities imposed by law based on the services actually provided.

References to securities, funds, asset classes, accounts, or platforms illustrate concepts unless otherwise expressly identified. They should not be understood as a determination that an investment or strategy is suitable for your circumstances.

Investing involves risk, including loss of principal. Past performance does not guarantee future results. Diversification does not eliminate investment risk. Projections, backtests, and hypothetical examples are illustrative, depend on assumptions, and may not reflect actual results, taxes, fees, or other costs unless stated.

You are responsible for evaluating your circumstances and deciding whether to consult a qualified professional before acting. We do not promise investment returns, income, wealth, or any other financial outcome. This statement does not limit any express purchase-related guarantee or mandatory legal right.

4. Accuracy, Updates, and Third-Party Information

We aim to provide accurate, useful information, but content may contain errors or become outdated. Laws, tax rules, contribution limits, prices, fund holdings, fees, and platform features may change.

Verify important information with current primary sources before relying on it. Content relating to a jurisdiction other than your own may not apply to you.

Links and references to third-party websites, tools, and services do not mean we control them. Their own terms and privacy practices apply. We are not responsible for their independent acts or omissions, except to the extent applicable law provides otherwise. Any material affiliate or sponsorship relationship will be disclosed where relevant.

5. Purchases and Payment

The price, currency, applicable taxes, and any recurring payment terms will be disclosed before you complete a purchase. You authorize charges that you expressly approve during checkout. Optional add-ons are not included unless you select them.

If a Service is subscription-based, its renewal frequency, price, and cancellation method will be provided in its separate purchase terms. Buying a one-time product does not authorize a subscription.

Please provide accurate billing and contact details and use a payment method you are authorized to use. Contact support@themarkethustle.com if you believe a charge is incorrect.

Changes in published prices do not change the agreed price of a completed purchase. Any changes to future subscription charges will follow the applicable purchase terms, notice requirements, and law.

6. Delivery and Access

The product description and checkout identify the delivery method and expected access timing. Digital products may be delivered through download links, email, or a content portal. Where instant access is advertised, access will be made available following successful payment, subject to temporary technical issues that we will work to resolve promptly.

If you do not receive access, check your spam folder and contact support@themarkethustle.com. We will help locate your purchase and resolve delivery problems.

Access duration and any included updates or support are determined by the offer you purchased. We will not use a later change to these Terms to redefine an existing "lifetime access" promise or shorten an agreed access period.

For downloadable products, you may retain authorized personal copies subject to your license and applicable purchase terms. Hosted access and downloadable copies are distinct. If we plan to discontinue hosting a paid product, we will provide reasonable advance notice and, where feasible, an opportunity to download included materials. Discontinuation does not eliminate contractual obligations or mandatory consumer remedies.

7. Personal-Use License and Intellectual Property

We or our licensors own the content and intellectual property in the Services. Purchasing access does not transfer ownership of that intellectual property.

Subject to these Terms and the applicable purchase terms, you receive a non-exclusive, non-transferable license to use purchased materials for your own personal, non-commercial purposes.

You may read and use the materials, complete exercises, make personal notes, and download, back up, or print materials offered for download for your own use. You may make personal working copies of included worksheets or templates.

Unless we give written permission or applicable law permits otherwise, you may not:

Redistribute, publish, sell, sublicense, or share purchased materials or account access with others.
Remove copyright or ownership notices.
Reproduce protected content for a competing product or commercial publication.
Circumvent access controls or scrape restricted content.
Upload purchased materials to publicly accessible repositories or systems that make them available to others.

These restrictions do not limit fair use or other rights that cannot lawfully be restricted. Rights in retained bonuses or materials following cancellation or another purchase remedy are determined by the applicable product-specific terms; they are not automatically revoked by these general Terms.

8. Accounts and Acceptable Use

Keep your login credentials secure and notify us promptly of suspected unauthorized access. Do not impersonate another person, attempt unauthorized access, disrupt the Services, distribute malicious software, or use the Services unlawfully.

In communities or interactive Services, do not harass others, disclose their private information without permission, infringe intellectual property rights, or post unlawful content. We may remove content that violates these rules.

You retain ownership of content you submit. You grant us a limited license to host, display, and process that content as necessary to provide the Service in which you submitted it. This is not blanket permission to use private submissions or your name in advertising. Any separate testimonial or promotional use will be handled with appropriate permission and disclosures.

Other users' posts are their own statements and are not necessarily reviewed or endorsed by The Market Hustle.

9. Coaching and Separate Services

Coaching, consultations, software, and other specialized Services may require separate agreements describing their scope, scheduling, deliverables, access, and other conditions. Those agreements control for the specific Service where they conflict with these Terms.

Educational discussions do not authorize us to manage your assets, execute transactions, or access your financial accounts. Do not provide brokerage passwords or other financial-account credentials through our educational Services.

10. Privacy and Communications

Our Privacy Policy explains how we collect, use, and handle personal information. Acceptance of these Terms does not constitute consent to every possible use of personal information or replace consent required by law.

We may send purchase confirmations, access instructions, security notices, and other communications needed to fulfill your purchase or administer your account. Marketing communications are subject to applicable consent and unsubscribe requirements.

11. Service Availability and Warranties

We use reasonable efforts to operate the Services, but do not promise uninterrupted or error-free availability. Maintenance, third-party failures, and events beyond our reasonable control may cause interruptions.

To the extent permitted by law, and except for express commitments made in the applicable purchase terms, the Services are provided "as is" and "as available," without implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

This section does not exclude warranties, consumer guarantees, or remedies that cannot lawfully be excluded, and does not override an express promise associated with your purchase.

12. Limitation of Liability

To the extent permitted by applicable law, The Market Hustle and its officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Services, including indirect losses of profits, revenue, or data.

This limitation does not apply to fraud, willful misconduct, gross negligence, or any liability that applicable law does not permit us to exclude or limit. It does not excuse our obligation to provide a purchased Service as agreed or honor applicable purchase terms and mandatory consumer rights.

13. Suspension and Termination

We may restrict or suspend access where reasonably necessary to address a material violation of these Terms, a security threat, unlawful conduct, or a legal requirement. Where practical, we will explain the reason and provide an opportunity to correct a remediable violation before terminating paid access.

Urgent safety or security concerns may require immediate action. Any restriction should be proportionate to the issue. Suspension or termination does not automatically eliminate rights or remedies under applicable purchase terms or law.

Ending hosted access does not, by itself, revoke rights to lawfully retained downloadable materials or bonuses. Obligations concerning intellectual property, unpaid authorized charges, and provisions that by their nature should survive will continue as applicable.

14. Changes to These Terms

We may update these Terms and will identify the effective date of each version. For material changes affecting ongoing paid Services, we will provide reasonable advance notice through email or another appropriate channel and obtain renewed agreement where required by law.

Updates will apply prospectively. They will not retroactively shorten purchased access, withdraw promised benefits, or reduce rights associated with earlier purchases without a valid agreement and compliance with applicable law.

15. Governing Law and Disputes

These Terms are governed by Washington State law, without regard to conflict-of-law rules, except where mandatory law requires otherwise. Consumers retain protections and rights to bring claims in venues available under applicable mandatory law.

Please contact support@themarkethustle.com if a dispute arises so we can try to resolve it. Contacting us is encouraged but is not a waiver of legal rights or a condition that prevents you from meeting legal filing deadlines or seeking urgent relief.

These general Terms do not require binding arbitration or waive class-action or jury-trial rights.

16. General Provisions

These Terms and the product-specific terms accepted for a purchase form the agreement relating to that purchase. They do not cancel express promises presented with the offer or rights associated with prior purchases.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later.

We may transfer this agreement as part of a lawful business reorganization or sale, provided the transfer does not reduce your purchased benefits or mandatory rights. You may not transfer paid access to another person without permission, except as permitted by law or the relevant purchase terms.

To the maximum extent permitted by law, The Market Hustle's aggregate liability arising out of or relating to the Services will not exceed the amount actually paid by the customer for the specific product or service giving rise to the claim.
